Copywritten music

I decided to look into copy-written music, as it is a big issue with what I want to create for my artefact, as it would mean that my posts could potentially get taken down, which would mean that nobody would see them which means that it would not have the desired outcome.

So,  I looked into what copyrighting is as to ensure that I have a good understanding of what it is and what I might have to deal with.

Copyright of a musical work begins automatically once a piece of music is created and documented or recorded. In the UK, this is detailed in the Copyright, Designs and Patents Act 1988.

There is no official method to copyright work in the UK. However, evidence of creation and ownership can be created by electronic emailing or saving of the work, which will provide a time-stamped copy.

As the owner of the work you have sole authority to:

- Copy the music
- Issue, lend or rent copies to the public
- Perform, show or play the music in public
- Communicate the music to the public (I.e broadcasting it via TV, radio, internet, etc.)

I then had a look into instagrams rules of copyrighted content.

According to their terms of use and community guidelines, you can only post content on Instagram if it doesn't violate the intellectual rights of another party. You can also use someone else's content if you have permission (such as license), or if it is covered by fair use or some other exceptions to copyright.

Fair use is:

1. The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes:

Does the use transform or change the original work by adding new meaning, context or expression? Parodies may be fair use if they imitate a work in a way that criticises or comments on the original work.

2. The nature of the copyrighted work:

The use of the factual words like maps or databases is more likely to be fair use than the use of highly creative works like poems or science-fiction movies.

3. The amount and substance of the portion used in relation to the copyrighted work as a whole:

The use of small portions of a copyrighted work is more likely to be fair use that copying an entire work. But even if only a small portion is used, it is less likely to be fair if that portion used is the most important piece - the "heart" of the work.

4. The effects of the use upon the potential market for on value of the copyrighted work:

Will the use replace the original work such that people stop buying or viewing the copyrighted work? If so, this is less likely to be fair use.

After reading that part of the Instagram website, I think that my work should be fine as it is going to be under the fair use 1. point, as it is meant to be educational.
